General Terms and Conditions

1. Applicability

In these general terms and conditions, ‘‘De Schat van Pachamama’’ means: ‘De Schat van Pachamama’ GCV, also trading under the name wolwereld

These general terms and conditions apply to all offers and orders at ‘‘De Schat van Pachamama’’ and agreements entered into with ‘‘De Schat van Pachamama’’. The customer cannot derive any rights for future transactions from any deviations from these conditions agreed in writing.

Placing an order means that one accepts these conditions. In the event of a written deviation from certain provisions, the other provisions of these general terms and conditions remain fully in force.

‘‘De Schat van Pachamama’’ reserves the right to change and/or supplement the General Terms and Conditions at any time for future orders or agreements.

2. Promotions and conclusion of agreement

Promotions are valid while stocks last.

An agreement is concluded at the moment that the order confirmation is sent by email to the email address provided by the customer.

3. Products and prices

The offered articles are depicted by ‘‘De Schat van Pachamama’’ as clearly and truthfully as possible on the website. The products shown may differ slightly from reality due to technical circumstances (e.g. colour setting of your computer screen). ‘‘De Schat van Pachamama’’ accepts no liability for this.

All prices stated on the website are in euros, including VAT and excluding shipping costs.

‘De Schat van Pachamama’ cannot be held to prices if the consumer could reasonably understand that they contain a typo or error.

Price changes apply from the moment they are published on the website.

Delivery costs are clearly communicated to the customer.

4. Ordering and payment
Payment can be made by bank transfer or via Shopify Payments, our partner for payment transactions (Bancontact, Ideal, Credit card or Paypal).

An agreement is only concluded after acceptance of your order by ‘‘De Schat van Pachamama’’. ‘‘De Schat van Pachamama’’ reserves the right, for whatever reason, not to execute orders or to execute them at a later time. ‘‘De Schat van Pachamama’’ will inform the customer of this in writing within 5 working days.

‘De Schat van Pachamama’ will only deliver the order after receipt of payment.

5. Delivery
‘De Schat van Pachamama’ strives to send the order as soon as possible after receipt of payment, in principle within 3 working days, if the items are in stock. Items that are only available to order = where stated 'to order' are sent after approximately 1 week if they are in stock at the supplier. If delivery is delayed for whatever reason, or if an order cannot be executed or can only be executed in part, you will receive a message by email.

The stated delivery time is never a fatal term. The delivery time will however never be longer than 30 working days after receipt of payment, unless there is force majeure or unforeseen circumstances or otherwise agreed.

'De Schat van Pachamama' makes every effort to keep the website and the stock as up-to-date as possible. However, it may happen that a product is no longer fully available. In that case we will contact you to discuss the possibilities.

If you still want to cancel the order, that is possible. 'De Schat van Pachamama' will in that case ensure a refund within 7 working days.

Deliveries take place at the address specified by the customer when ordering. If the delivery fails due to the actions of the customer, for example if the package is not accepted upon delivery, is not collected or is refused, the costs for any storage or resending will be borne by the consumer.

As soon as the products have been delivered to the specified delivery address, the risk with regard to these products is transferred to the customer.

The customer is obliged to take delivery of the purchased goods within the agreed period. In the absence thereof, ‘‘De Schat van Pachamama’’ may claim payment of the purchase price of the part not taken, or consider the agreement as dissolved without judicial intervention. (the customer will be reimbursed for any advance payments already made for the product, but shipping costs and administration/packaging costs will be deducted).

6. Right of withdrawal and exchange
The customer can, in accordance with the Belgian law on Market Practices and Consumer Protection of 6 April 2010, exercise the right of withdrawal within fourteen (14) working days after delivery of the product without penalty and without giving reasons. This right of withdrawal does not apply to skeins of wool that have been wound into a ball, books, patterns or other similar products or products whose packaging has been opened. There is no right of withdrawal if the product and packaging are no longer in their original, complete, undamaged and unused condition (including all wrappings and labels, skeins may not be wound into balls). All accompanying documentation, warranty certificates and packaging materials must be included with the return shipment. The return shipment must be made via the same route as the delivery, at the customer's expense.

In the event that the customer exercises his right of withdrawal, he is obliged to report this to 'De Schat van Pachamama' within fourteen (14) working days after delivery of the received product. The product must then be returned to 'De Schat van Pachamama' in the condition in which the customer received the product, within 7 working days.

If the customer has exercised the right of withdrawal as stated in the previous paragraph, 'De Schat van Pachamama' will ensure that the amount paid by the customer to 'De Schat van Pachamama' is refunded within ten (10) days via the same route as the original payment. If the return label was provided by 'De Schat van Pachamama', the shipping costs of the return shipment will be deducted from the refund: €6.

'De Schat van Pachamama' is never liable for any damage - including theft or loss - that occurs to the packaging or the product during return.

In accordance with article 47, §4, 2° of the Market Practices and Consumer Protection Act, the customer cannot exercise a right of withdrawal for agreements concerning the delivery of products that have been manufactured according to the customer's specifications or that have a clearly personal character or that cannot be returned due to their nature or can quickly spoil or age.

If the product has not been received in accordance with the terms of the right of withdrawal, the purchase price will not be refunded. The product remains the property of the customer, who is obliged to collect its property within two weeks.

7. Retention of title

Ownership of a product, notwithstanding actual delivery, will only be transferred to the customer after the customer has paid the full amount due for this product, including compensation for interest and costs.

The customer may not encumber, sell, deliver, alienate or otherwise encumber the products before ownership has been transferred.

8. Liability

Any liability of 'De Schat van Pachamama' for any damage whatsoever is expressly excluded. ‘De Schat van Pachamama’ is also not liable for damage caused by third parties during the execution of the agreement.

9. Force Majeure

In the event of force majeure, ‘De Schat van Pachamama’ is not obliged to fulfil its obligations towards the other party. ‘De Schat van Pachamama’ is entitled to suspend its obligations for the duration of the force majeure.

Force majeure is understood to mean any circumstance beyond its control that prevents it from fulfilling its obligations towards the other party in whole or in part. These circumstances include strikes, fire, business disruptions, power failures, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of the Website at any time, non-delivery or late delivery by suppliers or other third parties involved and the absence of any permit to be obtained from the government.

10. Applicable law and competent court

All offers and agreements are exclusively governed by Belgian law, excluding the principles of conflicts of law in space.

The applicability of the Vienna Sales Convention is expressly excluded.

All disputes relating to or arising from offers from ‘De Schat van Pachamama’, or agreements concluded with it, will be submitted to the competent court in Antwerp, unless a mandatory statutory provision expressly designates another court as competent.
